Overview of Services

Docuness is an RFP intelligence and proposal assistance platform designed to help users:

• Discover and match government contracting opportunities
• Analyze solicitations and extract requirements
• Generate AI-assisted proposal content
• Manage responses, workflows, and supporting documentation

Docuness provides tools to support decision-making but does not guarantee contract awards, eligibility, or outcomes.

Public Data, User Content, and Data Restrictions

Docuness may display or process information sourced from public records and third-party datasets, including listings and related fields from public contracting, procurement, or similar public systems.

Docuness is not affiliated with, endorsed by, or sponsored by any government, agency, operator of those systems, or other third party whose data may appear in the Service. We do not warrant that such information is accurate, complete, current, or fit for any particular purpose.

Public and third-party data may be incomplete, delayed, incorrectly indexed, or later revised by the issuing authority. You are solely responsible for verifying all material facts against official sources before relying on them for bidding, compliance, legal, financial, or other decisions.

Permitted Use and Restrictions

The Docuness platform is intended for public, non-sensitive business and procurement information appropriate to a commercial SaaS environment.

You must not upload, store, transmit, or ask the Service to process:

• Personally identifiable information (PII), except what you voluntarily and lawfully provide for your account and workspace in accordance with our Privacy Policy
• Payment card or other data subject to PCI DSS or similar regulations
• Trade secrets or other information you are required to keep confidential under contract, law, or policy, where the platform is not an approved repository
• Export-controlled, classified, or otherwise legally restricted information

You are responsible for your uploads (including files, pasted text, integrations, and prompts), including obtaining any necessary rights, consents, and licenses, and ensuring compliance with applicable laws and your obligations to customers, primes, agencies, and employees.

Confidentiality and Data Handling

Unless we have entered into a separate written agreement that expressly states otherwise, communications and content you submit are not guaranteed to be treated as confidential beyond what is described in our Privacy Policy and security practices.

Do not use Docuness as a substitute for systems required for attorney-client privilege, classified material, or other specially protected information.

AI and Automated Processing

Certain features use artificial intelligence and automated processing. AI-generated outputs may be incorrect, incomplete, or outdated.

These outputs are provided for assistive purposes only and do not constitute legal, compliance, financial, or professional advice.

Limitation of Liability

To the fullest extent permitted by applicable law, Docuness and its licensors and suppliers disclaim all liability for any loss or damage arising from your reliance on:

• Public or third-party data
• AI-generated content
• Any other information made available through the Service

This disclaimer applies except where prohibited by applicable law.

Eligibility

To use Docuness, you must:

• Be at least 18 years old
• Provide accurate and complete information
• Use the platform on behalf of a business or organization (if applicable)

You are responsible for all activity under your account.

Account & Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• Restricting access to authorized users only
• Notifying us immediately of unauthorized access

Docuness is not liable for losses resulting from unauthorized use of your account.

Subscription & Billing

• Certain features require a paid subscription
• Pricing is available on the Docuness website
• Subscriptions automatically renew unless canceled
• Free trials (if offered) convert to paid plans unless canceled before expiration

Payments are non-refundable unless otherwise stated.

Acceptable Use

You agree not to:

• Use the platform for unlawful, fraudulent, or misleading purposes
• Upload malicious code or harmful content
• Reverse engineer, copy, or resell the platform
• Misrepresent your business, certifications, or qualifications

Data & Content Ownership

Your Data

You retain ownership of:

• Company information
• Uploaded documents and proposal materials
• Responses and content generated from your inputs

You grant Docuness a limited license to process your data solely to provide and improve the service.

Platform Ownership

Docuness retains ownership of:

• Algorithms, scoring models, and matching logic
• Platform design, features, and functionality
• All underlying intellectual property

AI-Generated Content

Docuness uses AI to generate summaries, recommendations, and proposal drafts.

You acknowledge that:

• AI-generated content may be incomplete, inaccurate, or misleading
• Outputs are generated based on provided inputs and available data
• Content is provided “as-is” without guarantees of correctness or suitability

You are solely responsible for:

• Reviewing, editing, and validating all generated content
• Ensuring accuracy before submission

No Professional or Procurement Advice

Docuness provides informational tools only.

• The platform does not provide legal, contracting, or procurement advice
• Outputs are not guaranteed to meet government requirements or regulations
• Use of the platform does not create any advisory or fiduciary relationship

Government Contracting Responsibility

You acknowledge that:

• You are solely responsible for compliance with all applicable laws and regulations (including FAR and agency requirements)
• Docuness does not verify certifications, eligibility, or representations
• Submission accuracy, completeness, and compliance are your responsibility

Matching & Recommendations Disclaimer

Opportunity matching, scoring, and recommendations:

• Are based on heuristic models and available data
• Are provided for informational purposes only
• Do not guarantee eligibility, fit, or likelihood of award

Third-Party Data Sources

Docuness may incorporate data from third-party sources (e.g., SAM.gov).

We do not guarantee:

• Accuracy or completeness of third-party data
• Timeliness or availability of external systems

Disclaimer of Warranties

Docuness is provided “as is” and “as available.”

We make no warranties, including:

• Accuracy, completeness, or reliability of data or outputs
• Availability, uptime, or uninterrupted access
• Fitness for a particular purpose

Use of the platform is at your own risk.

Limitation of Liability

To the fullest extent permitted by law, Docuness is not liable for:

• Lost revenue, contracts, or business opportunities
• Errors in AI-generated content, matching, or recommendations
• Indirect, incidental, or consequential damages

Total liability is limited to the amount you paid to Docuness in the past 12 months.

Indemnification

You agree to indemnify and hold Docuness harmless from claims arising from:

• Your use of the platform
• Your submitted proposals or content
• Your violation of these Terms

Termination

We may suspend or terminate access if you:

• Violate these Terms
• Use the platform in a way that harms the system or other users

You may cancel your subscription at any time.

Changes to Terms

We may update these Terms from time to time.

• Material changes will be communicated
• Continued use constitutes acceptance of updates

Governing Law

These Terms are governed by the laws of the State of California, United States.
